These Terms of Service govern access to and use of the Noctilium website, customer accounts, products, and related services. The website is operated by Noctilium Industries LLC, doing business publicly as Noctilium.
By using the website or placing an order, you agree to these Terms. Please review them carefully before making a purchase.
You may use this website only for lawful personal or business purposes and in accordance with these Terms. You may not interfere with the website’s operation, attempt unauthorized access to systems or accounts, introduce malicious code, misuse customer information, or use the website in a fraudulent, abusive, or unlawful manner.
Noctilium may restrict or suspend access when reasonably necessary to protect customers, investigate misuse, maintain security, comply with law, or preserve website availability.
Customers may be permitted to purchase as a guest or create an account. You are responsible for providing accurate, current information and for maintaining the confidentiality of your login credentials.
You agree to notify Noctilium promptly if you believe an account has been accessed without authorization. Noctilium may restrict or suspend account access when reasonably necessary to protect the account, other customers, or the website.
Deleting an account removes login access and eligible saved account information, but transaction records may be retained when reasonably necessary for fulfillment, refunds, disputes, accounting, tax, fraud prevention, legal compliance, or legitimate business recordkeeping.
Noctilium works to provide accurate product descriptions, specifications, compatibility information, photographs, prices, availability, and processing estimates. However, website content may occasionally contain an error, omission, or outdated detail.
Product appearance may vary slightly because of lighting, display settings, material variation, manufacturing tolerances, production updates, or differences between prototypes, renders, and finished goods.
Customers are responsible for reviewing available product information and confirming that a product is suitable and compatible for its intended use before purchase.
Products may be offered as in stock, made to order, or through another fulfillment arrangement described on the applicable product page. Availability and processing estimates shown at the time of purchase apply to that order.
In-stock quantities may be limited. Made-to-order products may require additional preparation, manufacturing, finishing, inspection, or assembly time before shipment.
Processing and delivery estimates are estimates rather than guaranteed completion or delivery dates unless Noctilium expressly states otherwise in writing.
Prices are listed in United States dollars unless stated otherwise. Prices, availability, product specifications, and promotional offers may change before an order is placed.
Applicable shipping charges and taxes are calculated or shown during checkout before payment is submitted.
Discounts, promotional codes, and limited offers may be subject to separate conditions, expiration dates, product exclusions, quantity limits, and availability. Unless stated otherwise, promotions may not be combined and have no cash value.
Payments are processed through Stripe. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges, taxes, and shipping costs associated with the order.
An order may be delayed, declined, or canceled if payment authorization fails, the payment is disputed, fraud is suspected, or additional verification is reasonably required.
Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt of the order but does not prevent Noctilium from reviewing, rejecting, or canceling it before fulfillment.
Noctilium may cancel or limit an order affected by incorrect pricing, unavailable inventory, product-data errors, payment failure, suspected fraud, excessive quantities, an undeliverable address, or another material fulfillment problem.
If Noctilium cancels an order after payment has been collected, the canceled amount will be returned to the original payment method. The time required for the credit to appear may depend on the payment provider or financial institution.
Contact Noctilium as soon as possible to request an order cancellation, quantity change, or shipping-address correction. A request is not guaranteed once processing, production, packing, label creation, or shipment has begun.
Made-to-order, personalized, limited-release, or final-sale products may not be cancelable after work or fulfillment has started.
Noctilium currently accepts orders for shipment only within the United States.
By placing an order, you confirm that the shipping address is an eligible United States address. Noctilium may reject, cancel, or refund an order that cannot be shipped to the provided address.
Purchases are also governed by Noctilium’s Shipping Policy and Returns & Refund Policy.
Return eligibility may vary by product. Product-specific return terms displayed at the time of purchase apply to that item.
Certain products, including the current sticker release, may be identified as final sale and ineligible for ordinary returns or exchanges. Final-sale status does not prevent a customer from contacting Noctilium about a damaged, incorrect, defective, missing, or unfulfilled order.
By placing an order, creating an account, requesting a password reset, or contacting Noctilium, you consent to receive electronic communications necessary to provide the requested service.
These may include account-verification messages, password-reset links, order confirmations, payment notices, shipping updates, tracking information, security notices, and support responses. Transactional communications are separate from optional promotional marketing.
The Noctilium name, branding, graphics, logos, product designs, photographs, renders, text, software, page layouts, and other website materials are owned by Noctilium Industries LLC or used with permission.
These materials may not be copied, reproduced, modified, distributed, sold, reverse engineered, or used to create derivative commercial materials without prior written permission, except where such restriction is prohibited by applicable law.
Products must be installed, handled, maintained, and used responsibly and in accordance with available instructions, compatibility information, warnings, and intended use.
Noctilium is not responsible for damage caused by misuse, improper installation, unauthorized modification, incompatible equipment, neglect, abnormal conditions, or use outside the product’s intended purpose, except to the extent responsibility cannot lawfully be excluded.
Any express warranty offered for a product will be described with that product or in separate written warranty terms. Noctilium does not provide an additional written warranty unless one is expressly stated.
Nothing in these Terms excludes, limits, or modifies any warranty, remedy, or consumer right that cannot lawfully be excluded, limited, or modified.
Website availability and non-product services are provided on an as-available basis. Noctilium does not guarantee that the website will always be uninterrupted, error-free, or available at a particular time.
To the maximum extent permitted by applicable law, Noctilium Industries LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website, interruption of online services, or use of a product.
These limitations do not apply where liability cannot lawfully be limited or excluded, including rights or remedies available under applicable consumer-protection law.
The website relies on third-party services for functions such as payment processing, authentication, hosting, email, analytics, diagnostics, taxes, and shipping. Those services may be governed by their own terms and privacy notices.
Noctilium is not responsible for an outage, delay, error, or security event caused solely by a third-party provider and outside Noctilium’s reasonable control, except where responsibility cannot lawfully be excluded.
Noctilium may update these Terms as the website, products, business practices, or legal obligations change. The effective date above will be revised when an updated version is posted.
Changes apply prospectively from the posted effective date unless applicable law requires otherwise. Terms presented at the time of a completed purchase continue to govern that transaction where appropriate.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where another law must apply and cannot lawfully be waived.
If any provision of these Terms is found invalid, unenforceable, or unlawful, that provision will be enforced to the greatest extent permitted and the remaining provisions will remain in effect.
These Terms, the Privacy Policy, Shipping Policy, Returns & Refund Policy, product-specific terms, and any written warranty expressly provided with a product form the agreement governing use of the website and purchases from Noctilium.
